Gravity feed fuel systems sit in a gray area created by a regulation that's frequently quoted but rarely read past its title. This article breaks down what the rule actually says, how a 2026 update changed it, and how the answer differs for commercial and personal trucks.

Summary:

This is not a blanket "yes."

Whether a specific gravity feed kit is legal depends on three separate, independent factors:

  • How the kit is designed - feeding the factory tank/fill line is generally outside 393.65(d)'s restriction; feeding a carburetor or injector directly is not.
  • How the truck is used - commercial motor vehicles (CMVs) remain fully subject to 393.65 and 393.67; personal, non-commercial trucks are not governed by these FMCSA provisions the same way.
  • Where the truck is registered/operated - state vehicle codes are separate from federal rules and can be stricter. EPA emissions-tampering rules are a third, independent layer.

A kit can clear the federal fuel-system rule and still run into a state code or an emissions issue. Each factor below needs to be checked on its own.

What a Gravity Feed Kit Does

A gravity feed kit moves fuel from an auxiliary tank or in-bed tank into a truck's main tank (or, in some designs, toward the fuel delivery line) using elevation instead of an electric transfer pump. A typical installation includes:

  • An auxiliary tank mounted higher than the main tank
  • A fuel line connecting the two
  • A manual shutoff valve
  • A check valve or rollover valve to prevent overfilling the main tank

The appeal is mechanical simplicity: no transfer pump means one less electrical component that can fail. The tradeoff is that fuel flow depends entirely on tank placement and valve design, and a poorly built system can overfill the main tank or confuse the fuel level sensor.

The Regulation: 49 CFR 393.65(d)

This section of the Federal Motor Carrier Safety Regulations (FMCSRs) is titled "Gravity or syphon feed prohibited." Read in isolation, the title implies a full ban. The operative text is narrower:

“A fuel system must not supply fuel by gravity or syphon feed directly to the carburetor or injector.”

The restriction applies to feeding fuel directly into the carburetor or injector, bypassing the vehicle's engine-side fuel delivery components entirely. It does not address moving fuel between tanks. A kit that feeds an auxiliary tank into the factory tank or fill line, leaving the truck's own fuel pump and injection system to handle delivery to the engine, falls outside what this provision restricts.

A related regulation, 49 CFR 393.67, governs fuel tank construction, including the placement of withdrawal fittings. It contains a specific exception for diesel fuel tanks, which is the source of the common claim that gravity feed is "fine for diesel, murkier for gasoline."

The 2026 Rule Change

In May 2025, the Federal Motor Carrier Safety Administration (FMCSA) published a Notice of Proposed Rulemaking (Docket No. FMCSA-2025-0120) to amend 393.65(d). The rule was finalized in early 2026. It adds an explicit exception: auxiliary pumps with a fuel tank capacity under five gallons, mounted on a trailer chassis or trailer bed, used for purposes other than powering the vehicle, and operational only while the vehicle is stationary, are no longer subject to the gravity/siphon feed prohibition.

FMCSA's rationale, as stated in the rulemaking, is that this specific use case does not present a safety risk to commercial motor vehicle operation. The change is narrow in scope, it does not legalize gravity feed systems broadly, but it confirms that the agency views the original 1968-era rule as due for revision rather than stricter enforcement.

Commercial vs. Personal Use

Part 393 of the FMCSRs applies to commercial motor vehicles (CMVs) operating in interstate commerce: for-hire carriers, DOT-numbered fleet vehicles, and trucks over the weight and use thresholds that bring a vehicle under FMCSA jurisdiction.

A personal pickup that isn't operating as a CMV is not governed by these FMCSA provisions in the same way an over-the-road commercial truck is. That doesn't remove all regulatory considerations, state vehicle codes and emissions rules still apply, but the specific DOT gravity-feed prohibition is written for, and enforced against, commercial operations.

If a truck is used commercially, for-hire hauling, a business fleet vehicle, interstate operation under a DOT number, 393.65 and 393.67 apply in full, including the 2026 trailer-mounted pump exception where it fits the use case.

EPA and Emissions Considerations

Federal fuel-system rules are not the only regulatory layer. The Clean Air Act's anti-tampering provisions, enforced by the EPA, prohibit disabling, bypassing, or defeating emissions control equipment. A gravity feed kit that only transfers fuel between tanks and does not alter any emissions-related component is not, on its own, an EPA tampering issue.

Problems arise when a fuel modification has downstream effects on emissions-monitored systems. For example, an overfilled main tank triggering a false fuel-level or evaporative-system fault code, or a fuel modification bundled with unrelated changes that do affect emissions hardware. These are separate compliance questions from the DOT fuel-system rule and should be evaluated independently.

State-Level Requirements

States maintain their own vehicle equipment codes covering fuel systems, tank placement, and aftermarket modifications, independent of federal FMCSA rules. Some states apply stricter standards to auxiliary tank installations than federal regulations require. For a truck that will undergo regular state or DOT inspection, checking the applicable state vehicle code before installation is worth the time.

Installation Practices That Reduce Risk

Regardless of whether a given truck falls under FMCSA jurisdiction, these design choices keep an installation defensible:

  • Feed the factory tank or fill line, not the injector directly. This keeps the system outside what 393.65(d) restricts.
  • Install a check valve or rollover valve. This prevents overfilling the main tank - the most common cause of false fuel-gauge readings and check engine lights in gravity feed setups.
  • Follow 393.67 fitting and line placement guidance even where not legally required; it reflects sound engineering practice independent of jurisdiction.
  • Keep the modification scoped to fuel transfer only. Avoid any change that touches emissions-related components.
  • Document the system design. A clear explanation of how the system feeds the tank (not the injector) and how overfilling is prevented is useful if a DOT officer or state inspector asks about the installation.
